WHAT THIS VISA LETS YOU DO

The Safe Haven Enterprise Visa (Subclass 790)  allows you to:

  • stay in Australia temporarily if you engage Australia's protection obligations and meet all other requirements for the visa for up to 5 years.

  • Work and study

  • apply for Centrelink.

 

ELIGIBILITY FOR THE SAFE HAVEN ENTERPRISE VISA SUBCLASS 790

 

To be eligible for the Safe Haven Enterprise Visa (Subclass 790), you will need to:

  • not be able to make a vaild application for a Permanent Protection visa (subclass 866) and You must also:

    • be an unauthorised maritime arrival
    • have been refused immigration clearance at Australia's border when you last entered Australia, or

    • entered Australia without a valid visa, or

    • hold or have held in the past, one of the following visas:

    • Temporary Protection visa (subclass 785)

    • Temporary Safe haven visa (subclass 449)

    • Temporary (Humanitarian Concern) visa (subclass 786), or

    • Safe Haven Enterprise visa (subclass 790)

  • Either be a refugee or alternatively meet the complementary protection criteria.

  • Prove your identity, citizenship and biometrics.

  • You can't make a valid Safe Haven Enterprise (SHEV) visa application if you:

    • are an unauthorised maritime arrival, or

    • did not clear immigration when you arrived in Australia, or 

    • have been refused a protection visa since your last arrival to Australia, or

    • have had a protection visa cancelled since your last arrival to Australia, or

    • are a national of 2 or more countries, or

    • have protection in a prescribed safe third country, or

    • hold or held a Humanitarian Stay (Temporary)(subclass 449) visa since last entering Australia and are not an unauthorised maritime arrival or a transitory person

    • The Minister has the power to lift any application bar if it is determined to be in the public interest.

    • We will let you know if an application bar affects your SHEV application.

  • Meet health requirements.
